Cipriano Ramirez alleges he developed cancer after he was exposed to talc-containing asbestos while working as a janitor at an Avon facility in a suburb of Chicago during the 1980s. He was diagnosed with mesothelioma, an aggressive and rare cancer that develops in the lining of the lungs.
The cancer victim filed a lawsuit against Avon Products, Inc., the holding company accountable for Ramirez’s asbestos exposure during his employment. Avon is a well-known brand that sells eyeshadow, lipstick and more cosmetics. The company traces its roots back to the 19th century – and for much of its history has relied on talc as an ingredient in its product line.
On July 26, after more than a month-long trial, a Chicago jury ruled in favor of plaintiffs Cipriano and Maria Ramirez for the sum of $24.4 million in damages.
Previous Talc Exposure Lawsuits
There have been tens of thousands of lawsuits filed in recent years against companies with talc products. Talc products have been linked to asbestos contamination, leading to harmful cancer diagnoses, including mesothelioma. Johnson & Johnson, for example, has nearly 60,000 talc cancer lawsuits pending against the company because of its talc-containing products.
Johnson & Johnson Baby Powder is the health and beauty conglomorate’s most prominent example. The product was arguably the most popular baby powder on the market for decades, but it was made with talc and linked to many cases of mesothelioma and ovarian cancer. Johnson & Johnson discontinued its talc baby powder product in 2020.
As talc-related litigation continues, these cases highlight the dangers associated with talc exposure and the importance of holding companies accountable for the harmful effects of their products.
How is Talc Dangerous?
There is a link between the use of talc products and cancer, specifically due to the connection between talc and asbestos. Talc is a mineral that occurs naturally in the earth. Deposits of talc are mined for use in cosmetic and health products due to the mineral’s ability to absorb moisture and keep skin dry.
Asbestos is also a naturally occurring mineral, and deposits of asbestos are often found in the same geographic areas as talc. Asbestos is the only known cause of mesothelioma, and can also cause other types of cancers such as ovarian and lung.
When talc is mined for, it’s possible for asbestos to be unintentionally mined along with it and mix with the harvested talc. This talc is then ground into a powder – called “talcum powder” – and used in beauty and health products, thereby exposing plant workers and product consumers to asbestos.
